Conditions:

The carrier shall be responsible to send us the certified CMR by fax immediately after unloading the goods.

• The automobile should be fit for international transportation and equipped with all necessary documents and CMR – Insurance.
  
• The exclusivity/liability by the Carrier not to agree in direct or indirect manner with the client of Bulgaria Trans Ltd. within 6 (six) months as of the date of signing this purchase for carrying out transportation(s) shall be deemed concluded and in the case of failure to comply with this obligation the Carrier shall pay a penalty in the amount of 2 000 EUR (two thousand EUR).
  
• The Carrier shall ensure that the vehicles he uses are in good technical repair and fulfill the requirements set out in the law and other relevant enactments.
  
• According to the rules of the Convention on the Contract for the International Carriage of Goods by Road (CMR) the Carrier shall answer to Bulgaria Trans Ltd. in his quality of first carrier and the carriers contracted by him shall be deemed subcontractors. The Carrier shall declare that he owns an active CMR – insurance and that all due premium has been paid. In case of failure, the Carrier shall be liable to inform Bulgaria Trans Ltd. in writing thereof before accepting the cargo so as to allow Bulgaria Trans Ltd. to carry out the necessary actions on contracting the insurance at the expense of the Carrier. In case of absence of active CMR insurance the Carrier shall have direct and sole responsibility for all damage caused.
  
• By confirming this purchase through the means of a replying fax on the part of the Carrier, the Carrier and Bulgaria Trans Ltd. shall enter under a contract for transportation according to the conditions set out in the purchase, as the Carrier shall be obliged to carry out the transportation according to these conditions and the applicable domestic and international enactments.
  
• In case of failure to comply with the conditions set out in the contract for transportation, the Carrier shall bear the sole responsibility under the provisions in the law and other relevant enactments.
  
• The Carrier shall be responsible for all claimed demands to Bulgaria Trans Ltd. in relation to the complete or partial loss or damage of the cargo as of the moment of accepting the cargo for transportation on his part until its delivery, as well as delay in its delivery in which case the repair of the damage shall be at the expense solely of the Carrier.
  
• In the case of damage or loss in relation to the transported cargo, notwithstanding the amount, type or reason, the Carrier shall be obliged to comply strictly with the time limit and the procedures for preparing the necessary documents in this relation and to immediately inform the competent authorities, Bulgaria Trans Ltd., the cargo giver, and the recipient of the event in question. Bulgaria Trans Ltd. is strictly keen on the implementation of this obligation and in case of failure to comply therewith, the Carrier, apart from being responsible for the particular damage or loss, shall pay to Bulgaria Trans Ltd. a penalty in the amount of 800 EUR.
  
• The Carrier shall see to the issuing of T1 and T2L documents (if necessary) and their clearance at the receiving customs office accordingly.
  
• In case of non-confirmation of the purchase by fax/e-mail when the cargo is loaded the contract for transportation shall be deemed for concluded.

All other conditions for carrying out the transportation shall be in accordance to the Convention on the Contract for the International Carriage of Goods by Road (CMR), as well as the General forwarding conditions and general warehouse conditions, adopted by the Bulgarian National Forwarders Association, publication in 1996. All conflicts which arise during or in connection with the concluding, interpreting, action, implementation, defaulting or termination of the contract for transportation which cannot be solved amicably through negotiations between the parties, shall be taken before the Court of Arbitration under the Bulgarian Chamber of Commerce and Industry – the city of Sofia.
